They’ll just argue that the president gave him that authority. Trump’d also auto-pardon the guy, and anyone else the dems go after, so long as he’s president. It’s likely why democrats are claiming they won’t go after people as a priority. If in 2 years Americans elect a democrat (big if, as 2 years of blue-dominance “may” re-energize the republican base, and 2 years of duck l’orange may be enough for Americans to forget), then I’d say its more plausible they’d try to hold someone accountable… but also, at that point, they may just try to ‘move on’ / ‘turn the page’, feigning moral high ground, while allowing their cohorts to get away with their actions.

Like left and right wing politicians are really two sides of the same coin, pushing the same broad agenda. In Canada, for example, we just saw a case where a conservative unknown came into power… in large part, I’d argue, because the left-wing incumbents had backed themselves into a corner they couldn’t get out of: the party leader wanted to repeal bad legislation, but factions in his party veto’d it. They couldn’t balance the books, largely because public sector workers just kept getting hired, and unions won pretty much every negotiation, because the left wing government had to be pro-union all the time – so public sector salaries were tanking gov spending. They made a giant mess trying to push their social policies, got a few wins in the process… but then noped out, to let the conservatives come in and be the ‘bad guys’ cutting things. Then when people get annoyed by cuts, the left wingers can get in to power in a future election cycle, and start the process over again.
