      Not necessarily, far too many unknowns to state that for certain. Certainly unethical, illegal/rape would depend.

        Ok, could you describe a situation in which it wouldn’t be? Just 1. And i will agree with you.

        But with 1 condition: it can’t be “the ex bf understands that the person has a std and agrees to have unprotected sex”.

          ‘Agrees to have sex’ is all that is needed. Not disclosing std is abhorrent and illegal, but it’s not rape per se.

            It might qualify as rape by deception. When you consent to something, especially sex, it’s under certain circumstances. If you consent to sex with a condom, then the partner surreptitiously removes it, that’s rape by deception. I think it’s a fair expectation that someone would disclose std status if they knew about it.

            I believe it depends on where in the world you are. If I recall a lot places do quality that as sexual assault and rape.

          The gender of the infected person isn’t specified, in UK law, a woman doesn’t commit rape even if she forces someone to have sex at gunpoint. Other crimes would be committed but not rape.

          I know its common to hear women can’t commit rape but I am not 100% on what using your hands counts as so that might be a possibility. IIRC rape law is over penetrating someone else.

            So you don’t argue that it isn’t rape but just, that it is not legally rape in the UK.

            Just as a sidenote, It would be legally rape in e.g. germany.

            But I give you the point, because of the hand thing. While the conversation is probably not about doing something with their hand. But maybe the person has aids and is just supposed to inject their blood into the victims veins. Then it is not rape. Still a disgusting act of violence but no rape.

              Well unethical either way, just not guaranteed to be rape in the eyes of the law. Probably other crimes instead.

      I also wonder that, because even if assuming if it was consentual, no sane person would have sex without protection.

        Well it wouldn’t be consensual if she would not disclose a known std to her partner when engaging in unprotected sex.

        For the same reason, “stealthing” is rape. Or “surprise analsex” is rape. Any deviation from what was consented to, is rape, especially if the intention was to misguided the victim.

          This is what i mean. It is okay for people to have unptotected sex, but only if both people consent to it, and if they understand the risks of stds and pregnancy. This is why unprotected sex without understanding those risks is rape, even if people did consent.
